How much power do HOAs wield?

Before you decide to purchase a new Georgia home, you should find out whether or not the home falls under the auspices of a homeowners’ association. If so, you should then carefully read and study the rules and bylaws of the HOA. Why? Because having to adhere to some of those strict rules may turn your homeowner joys into a homeowner’s nightmare.

FindLaw explains that the power a homeowners’ association wields varies from HOA to HOA. However, most HOAs do, in fact, restrict the following:

  • Which colors you can paint your exteriors
  • Which colors and types of siding you can install
  • Which colors and types of roofs you can install
  • Which types and heights of fencing you can install
  • Which types and heights of landscaping you can have
  • Which types and the number of pets you can have

But the restrictions may not stop there. Some HOAs dictate the types of vehicles you can park in your driveway or on the street. Your HOA’s rules may even prohibit you from parking or storing an RV anywhere on your property. If your family has small children, also make sure you understand what kinds of playground equipment you can install for them and where you can install it. Pay particular attention to any rules regarding the size and type of boats and docks allowed if the property surrounding the home you want to purchase abuts a lake, river or stream. Finally, make sure you fully understand the dues and fees assessed by the HOA that you will have to pay and when you will need to pay them.
